Terms of use of services

RULES FOR USE OF CITYHOST SERVICES

The services provided by CityHost must be used by the Customer only for legal purposes and not contradict the current legislation of Ukraine and international legislation.

The information presented below are the rules for using the services of the sites https://cityhost.ua/ and https://citydomain.com.ua/

The fact of acceptance of the terms of this contract is the registration of an account in the system.

1. CUSTOMER ACCOUNT

1.1 When registering, the Customer is obliged to provide complete, true, reliable, correct and accurate data about himself, as well as contact data in the amount required for the provision of services by the Contractor.

1.2. When registering an account, the use of virtual telephone services, as well as services for sending and receiving SMS messages, is prohibited.

1.3. The Contractor reserves the right to check the authenticity of the data specified by the Customer at any time by requesting certified copies of the necessary documents: copies of the passport, driver's license, other documents capable of confirming the authenticity of the Customer's data.

1.4. In case of failure to provide the documents required for identification or failure to perform the necessary actions for identification, the Contractor reserves the right to temporarily or completely suspend the provision of services without returning the paid funds.

2. LIST OF MATERIALS PROHIBITED FOR POSTING

2.1. The services provided to the Customer must be used only for legal purposes and must not violate the current legislation of Ukraine, as well as international legislative acts.

2.2. When using the Contractor's services, it is prohibited to:

- publish information that violates the copyrights of third parties,

- use hosting accounts as storage for backup copies of sites and (or) databases.

- use the Contractor's servers as proxies or anonymizers.

2.3. Inadmissible materials for placement:

- financial pyramids, online casinos, sites dedicated to "MMM" and advertising of financial pyramids, betting sites, lotteries, gambling sites;

- pirated archives of movies, music, books, television and computer programs, games (even if the files are physically located on other servers);

- torrent trackers, crack, warez distribution resources;

- materials and goods that encourage illegal activity or the sale of information that was obtained illegally, as well as materials that incite others to participate in illegal activity;

- sites that distribute smoking mixtures, tobacco products, narcotic substances and marijuana seeds, or sites that advertise similar activities;

- materials for campaigning of political parties or political propaganda;

- pornography, sexually oriented content, webcam sites, escort service sites;

- game-related sites, game servers regardless of genres and types of game activity;

- phishing sites;

- services or scripts for sending spam;

- services or scripts for network scans;

- services for the distribution of malicious software, malicious shells or various scripts that perform actions without the user's knowledge;

- password selection services or scripts, parsers, indexers and crawlers (for scanning and obtaining information from other sites).

2.4. The contractor reserves the right to suspend or completely refuse the provision of services in case of suspicion of the customer's use of the service in illegal activities or in violation of the legislation of Ukraine or other countries.

2.5. The contractor reserves the right to suspend or completely refuse the provision of services in case of receiving substantiated complaints from other network users and in case of lack of reaction (elimination of the causes of complaints) on the part of the customer.

2.6. The Contractor reserves the right to suspend or completely refuse to provide services with complete deletion of the data posted by the Customer in case of receiving complaints from one or more higher providers: Hetzner Online GmbH, Serverius, COSMONOVA | NET, LLC "VOLYA-KABEL" or other partners of the company involved in the provision of services by the Contractor.

3. MALICIOUS SCRIPTS AND SOFTWARE

3.1. It is forbidden to post or allow the posting of viruses and malicious scripts.

3.2. If they are detected, the Contractor notifies the Customer and provides a list of infected files for cleaning the account. If the Customer does not take appropriate measures within the given time, the Contractor has the right to fully or partially limit the provision of services.

3.3. The customer bears full responsibility for actions taken in his account, including cases of infection with malicious scripts and dangerous software.

4. USE OF EMAIL SERVICES

4.1. Mass mailing of unsolicited emails (spam) is prohibited. If spam is detected, the Customer's account will be blocked.

4.2. If, due to the Customer's fault, the IP address belonging to the Contractor is blacklisted, the Customer's account will be blocked immediately.

4.3. In the case of mass mailings to non-existent addresses, the Customer's account may be temporarily limited or completely blocked.

5. USE OF FILE SYSTEM RESOURCES

5.1. The space provided for hosting within the tariff plan is intended only for storing site files and system files that are created when creating a hosting account. The use of server space as data storage is prohibited. This item includes the impossibility of storing:

- archives of backup copies of sites and backup copies in general, more than one week;

- photos, videos and audio files that do not belong to the site files and are not used as content for the site;

- invalid files of cached objects created by site scripts that are not automatically cleaned by site scripts;

- databases that are not used by sites and are stored on the server only for remote management or connection.

5.2. Cached pages generated by site scripts must not exceed more than 3 GB of disk space and must not exceed 10,000 inodes.

5.3. Media content (example: avi, bmp, bz2, css, doc, docx, eot, fla, flv, gif, gz, htm, html, ico, jpeg, jpg, js, mkv, mov, mp3, mp4, mpeg, mpg, odf, odp, ods, odt, ogg, otf, pdf, png, ppt, pptx, rar, rtf, svg, swf, tar, tgz, ttf, txt, wav, wbmp, webp, wml, wmlc, wmls, wmlsc, woff, woff2, xls, xlsx, zip and others) hosted within the Unlim hosting tariffs should not exceed the disk space limitations for each individual site. According to this rule, an unlimited number of sites can be hosted within one Unlim hosting account, but each of them must comply with the storage limitations of its media content. Information about the restrictions can be found in the Unlim hosting table on the main page.

5.4. For each tariff, there are restrictions on the number of inodes (files) that can be placed in a hosting account. Information about restrictions is given in the table on the main page. For the Smart tariff, the limit is 75,000 inodes;

5.5. If the limits are excessively exceeded, the Contractor sends a message to the Customer with a request to reduce the amount of consumed resources within 48 hours. If the Customer does not reduce the amount of consumed resources within 48 hours from the moment of receiving the notification, the Contractor reserves the right to suspend the provision of services.

6. USE OF MySQL DATABASE RESOURCES

6.1. The maximum allowable execution time of sql queries is 30 seconds.

6.2. The maximum allowable volume for one database is 2 GB and the number of tables is 1000.

6.3. The total volume of databases in the account should not exceed 4 GB.

6.4. Remote use of databases created on cityhost.ua servers for scripts that run outside cityhost.ua servers is not allowed.

6.5. The volume of databases is included in the total quota of disk space of the hosting account.

6.6. In case of violation of clauses 6.1. and 6.2. The contractor reserves the right to temporarily or permanently suspend the provision of services.

6.7. In case of violation of clauses 6.2. and 6.3. The executor reserves the right to temporarily or permanently limit access to the execution of requests (INSERT, UPDATE, CREATE) until the situation is corrected.

7. USE OF PROCESSOR TIME AND RAM RESOURCES (CPU and RAM)

7.1. For each hosting account in the system, 2 cores and 2 GB of RAM are allocated. The percentage of CPU load includes the total consumption of processor time from allocated cores. If, for example, the daily indicator is 8%, it means that in 24 hours the account consumed a total of 8% of the total capacity of the allocated cores on the server.

7.2. For each tariff there are restrictions on the use of processor time. Information about restrictions is in the table on the main page. For the Smart tariff, the limit is 3%. The daily limit includes the average value of resource consumption during 24 hours. This parameter shows the actual CPU percentage consumption of the hosting account. The daily limit can vary within + 20% of the set limit. This means that for the Penthouse tariff plan, for example, fluctuations of up to 18% are the norm (15 * 0.2 + 15 = 18).

7.3. It is allowed to use 100% of the allocated processor load account, no more than five minutes.

7.4. It is allowed to use 100% of the allocated RAM of the account, no more than five minutes.

7.5. The average daily RAM consumption should not exceed 256 MB.

7.6. In the case of exceeding the above limits within 5 calendar days, the Contractor shall notify the Customer to the email address of the need to correct the situation with exceeding the consumption of the specified resources within 72 hours. If the Contractor does not correct the situation with excess consumption of resources within the given time, the Contractor reserves the right to automatically change the Customer's tariff plan with the transfer of funds for the remaining period in favor of the tariff plan that includes the resources consumed by the Customer. In case of excessive or systematic exceeding of the limits within 5 calendar days, which are not included in any of the tariff plans, the Contractor reserves the right to suspend the provision of services.
